The obvious problem: Wills go missing!  Either through the passage of time, insufficient record keeping, the existence and whereabouts of a person's Will not being properly communicated to those left behind and the possibility of unscrupulous hands. Who can Register a Will? 

You or a third party acting on your behalf may register your Will. The registration form requires "Registrant Details" in the case of registration by a third party.

Registration is required for inclusion in the SARWT Will Register

PRegister a will 9Karticipation in the SARWT Will Register initiative is voluntary and open to all members of the public.

Either you or someone on your behalf have to submit the administrative details of your Will/Living Will for inclusion in the SARWT database via the "Register a Will" function available on the SARWT website in order to effectively register your Will.  In other words registration of your Will is required for inclusion in the SARWT Will Register.

Failure to register  your Will, will produce a negative search result should someone Search for a Will on this website. backtotop ii

 

What information do you need to Register a Will? 

In order to "Register a Will" on the SARWT website, we require the following administrative details:

Testator/Testatrix
•    Full Names, Surname, Identity Number, Date of Birth and Email Address.
•    Please note we do not require any further personal information.
•    The email address provided in never made available and is only utilised to confirm registration.

Executor/s
•    First Executor, Name, Contact Number and Email Address.
•    Is a second Executor appointed? (if yes, same details as above).

Original Will
•    Original Will: Dated, Kept at, Contact Person, Contact Number and Email Address.

Living Will
•    Does a Living Will exist?
•    If Yes: Date of Living Will, Kept at, Contact Person, Relationship, Contact Numbers and Email Address.
•    Second Contact? (If yes, same details as above, preferably someone not living with Testator/Testatrix).

Register a will 9KOrgan Donor Status
•    Organ Donor: Yes, No or N/A.
•    N/A: not unavailable at time of registration.

Registrant Details
•    Testator/Testatrix confirms his/her identity.

My loved ones know where my Will is stored, do I still need to register my Will?

Bearing in mind that participating in the Will Registry initiative is voluntary, we would recommend "Yes".

Life is unpredictable with change being the only constant! What if you make a new Will or amend the existing one, appoint another executor or move your Will to another location for safekeeping and omit to inform your loved ones?

There is no prejudice in registering your Will, it is free and will ensure your Will does not go undiscovered providing you and your loved ones with peace of mind.

Consider the following: “My mom never would have.... there has to be a another last Will and Testament!”. By registering you will create certainty, limiting potential family disputes concerning your last wishes, confirming that the Will in question is in fact your last Will and Testament. backtotop ii

Register a will 9KIt is imperative that you record the details of your new and updated Will via the Edit function on the SARWT website! Once your amended details are recorded, a complete registration history will be available in subsequent searches. backtotop ii

Who will benefit from Registering a Will? 

As Testator or Testatrix: Registration will ensure that your Last Will does not go undetected, give voice to your last wishes and necessitate exclusion of the rules of intestate succession.

Register a will 9KAs Beneficiaries: Registration will ensure that the Testator’s wishes are adhered to and that you receive the benefits as intended by the Testator.  Location details of the Will, together with contact details of the executor will be available to expedite the administration process.
